The attorney for Glenn Mishuck said the 17 counts should be dismissed because the teacher's alleged relationship with the student happened over the summer and Mishuck therefore wasn't the student's teacher, according to ctnews.com.

Superior Court Judge Maria Kahn disagreed Thursday and ordered Mishuck to stand trial on the charges, ctnews.com reported.

Mishuck was arrested in October 2013 and charged with 17 counts of second-degree sexual assault.
